Terms of Service

1 · Provider and scope

alpflo (the “Provider”) provides checking and reporting services on Swiss properties and building projects — in particular the plan check, the area check, the register brief and related services agreed case by case. These terms apply to each of those services and to any future service the Provider offers under this name, unless the engagement confirmation says otherwise. The Provider is:

By accepting an engagement confirmation you agree to these terms. Deviating terms of the client apply only if the Provider accepts them in writing.

2 · What you receive

The Provider delivers three deliverables; which of them your engagement covers is stated in the engagement confirmation.

Plan check. It checks the plans and application documents of a building project against the applicable rules and states, for each rule, what it requires and what the application claims. Every check ends in one of four results: met, not met, with reservation or not governing. A value marked “~” is derived by alpflo from a model or geodata, not read from the primary source; verify it at the source.

Area check. It checks the areas that follow from your floor plans against the applicable area rules. It ends in the same four results (met, not met, with reservation, not governing), and the same rule holds for “~”: derived, not read. An on-site measurement is not part of it.

Register brief. It compiles a property's register facts in one document, each with its source and as-of date. The four honesty states: every item carries one of four states, which the brief itself explains in its legend. It restates what the register holds, not that it is correct.

3 · Engagement, delivery and acceptance

Each engagement is agreed individually. You describe your matter by e-mail; the Provider confirms the subject, scope, fee and delivery date in writing by e-mail (the “engagement confirmation”). The engagement is concluded when you accept that confirmation by e-mail. Whatever the engagement confirmation does not name is not part of the engagement.

The deliverable is delivered as a PDF to the e-mail address named in the engagement confirmation. The delivery date assumes that the documents needed are complete and provided in time; the Provider may rely on the documents you provide being accurate.

If a deliverable departs from the confirmed scope, report it by e-mail within 10 days of delivery; the Provider corrects it at no additional fee. Without a report within that period the deliverable is deemed accepted.

4 · What a deliverable is — and what it is not

A deliverable compiles information from public Swiss registers, open geodata and the documents you provide, and states for each item where it comes from and how far it can be relied on. It restates what the public record says: registers can be incomplete, out of date or differ from reality. An item taken from a register means the register holds it, not that it is correct. For any binding decision, verify at the authoritative source.

A deliverable is information. It is not legal advice, not a property valuation or price estimate and not a decision on what may be built on a parcel — only the competent authority decides that. The Provider owes diligent work, not a particular outcome such as the granting of a permit.

Natural hazards, property valuation and heritage or ISOS status are deliberately not part of a deliverable. Which registers and sources an engagement covers depends on the canton and on what the respective office publishes. An on-site measurement is not part of a deliverable.

5 · Use, data sources and rights

You may use a deliverable for the property or project it was prepared for, including towards your own client. You may not resell, redistribute, scrape or bulk-extract a deliverable or the data behind it. Source attributions shown in a deliverable must be kept.

The data comes from official and open sources — among them swisstopo/GeoAdmin, the Federal Register of Buildings and Dwellings (GWR) of the Federal Statistical Office, the cantonal ÖREB cadastres, the Federal Office for Spatial Development (ARE), the Swiss Federal Office of Energy (SFOE), cantonal registers such as GEAK/CECB and OpenStreetMap (ODbL). The terms of use of those sources apply to your onward use; a deliverable grants no licence to register data beyond the engagement.

The structure, presentation and method of the deliverables remain the Provider's intellectual property. The Provider may use general insights gained from engagements to develop its offer.

6 · Fee and invoice

The fee is a fixed amount per engagement, stated in the engagement confirmation. It is invoiced after delivery and payable within 30 days of the invoice date by bank transfer. Nothing is sold through the website.

If you withdraw an accepted engagement before delivery, the work done up to then is invoiced, at most up to the agreed fee. In the event of late payment the Provider may withhold further services until payment.

7 · Liability

The Provider makes no warranty beyond what is expressly stated in these terms and in the engagement confirmation. The Provider is not liable for indirect or consequential loss arising from reliance on a deliverable — including decisions made in connection with a building project or a property transaction — nor for errors that result from incomplete or inaccurate documents or register entries.

Otherwise the Provider's liability arising from or in connection with an engagement is limited to the fee paid for the engagement concerned. Liability that mandatory Swiss law does not allow to be excluded, including for intent or gross negligence, is reserved.

8 · Governing law, language and changes

These terms and each engagement are governed by Swiss law. The place of jurisdiction is the Provider's Swiss domicile, subject to any mandatory place of jurisdiction in your favour.

The Provider may update these terms; the version published when an engagement is confirmed applies to it. These terms are written in German, which is the governing language; where a French or English translation differs, the German version prevails. Questions about these terms: info@alpflo.ch.
